GUARANTEE TERMS

Definitions

In this agreement, the following words have the following meanings:

“Time frame” The time/s from implementation from when customer prospecting begins.

“Opportunity Goals” The achievement/s of new business opportunities required within the “time frame” to which the  Guarantee applies.

“Services” The provision of Linkedin Outreach Professional services to procure prospective customers for the Client.

“Campaign Particulars”  The Campaign Particulars provided by the Company to the Client setting out the Client, Fee, Scope, Minimum Term and Guarantees.

“Client” The Client, as detailed within the Campaign Particulars and including its representatives.

“Company”        The Company, as detailed within the Campaign Particulars and including its representatives.

“Guarantee Provision” Achieving the Opportunity Goals by the Guarantee Term (if applicable).

“Term” The period between the Agreement Date and the date this agreement is terminated.

“Strategy” The plan of action designed to achieve a long-term or an overall aim.

Guarantee

1. The “Company” guarantees to achieve the “Opportunity Goals” within the period of the “time-frame” for the “Client” according to the “Campaign Particulars”. In the event that the “Opportunity Goal” of the guarantee is not met, the “Company” agrees to continue to provide the “Services” free of charge until the “Opportunity Goal” is achieved. This guarantee does not limit any rights the Client has under the Australian Consumer Law.

a. The guarantee/s offered, if any, are determined prior to the campaign commencing. The “Client” acknowledges that pricing for the “Services” may vary depending on the type of Guarantee offered.

b. The Guarantee Terms apply in addition to the Terms of service.

c. The guarantee/s do not apply in the following circumstances:

i. If changes are made to the “strategy” by other parties (including the “Client” that adversely affect the ability of the “Company” to achieve their set milestones; or

ii. If the “Client’s” Website or social profile is offline or inaccessible for more than 7 days due to a reason not caused by the “Company”.
